What Victorian law requires from a seller

In Victoria, every advertisement to sell, rehome or give away a dog must display two things: the puppy's microchip number and the seller's source number.

Source numbers come from the local council for a registered domestic animal business, or from the Pet Exchange Register for recreational breeders, microbreeders and rescue groups. Advertising without them is an offence, carrying a maximum penalty of five penalty units.

The rule covers ads that give a dog away for free, and interstate sellers advertising to Victorians. A vet cannot exempt a puppy from being microchipped for an ad. An ad about a litter that is not yet born or for sale, and names no individual puppy, can go without the numbers, but must be updated with them once the puppies are for sale.

This matters to you as a buyer because it is a quick legitimacy check: you can search a seller's source number on the Pet Exchange Register before you buy. If a Victorian listing for a puppy that is for sale is missing either number, the seller is either unaware of the rules or avoiding them, and neither is a good sign.

Under the same rules, a microbreeder keeps one or two fertile females and a recreational breeder, who must be a breeding member of an applicable organisation such as Dogs Victoria, up to ten. A breeder outside those organisations with three to ten fertile females must register with their council as a domestic animal business, and keeping 11 to 50 fertile female dogs also needs commercial dog breeder approval. A seller with many litters running at once should be able to explain their registration.

When you buy, the seller must give you the puppy's microchip certificate with a signed change of ownership form.
